Nothing has made me smile more than finding out that this awful decision by Sotomayor was overturned by the Supreme Court. Clearly this woman is a racist. I, for the life of me, could not figure out how she got away with ruling the way she did on those firefighters. It defies reason and responsibility. I guess I can understand why BO nominated her – she is a racist and her decisions defy reason and responsibility. They have so much in common!
Oh, you poor misguided fools. You refuse to understand how a minority woman with the wisdom of her years and experience understands so much more than a few learned crackers that sit on the bench on the highest court in the land. (All said with extreme sarcasm.)
According to Kermit Roosevelt, who clerked for Supreme Court Justice David Souter, and teaches law at the University of Pennsylvania's law school, "…the way people think about Ricci (the PA firefighters) – and this includes the justices – is in large part shaped not by logic or law but by their attitudes about the world. In particular, it depends on whether they think it is more likely that minority candidates were simply not as good as the whites, or more likely that there was some unintended bias skewing the results. When we ask whether empathy or life history are appropriate qualifications for judges (Sotomayor), we should be thinking about these cases. We like to believe we write laws that judges can apply as if they were machines. We like to believe that about the Constitution, too. But in cases such as Ricci, the human element enters the law. Then we learn a little bit not just about how our judges think, but about who they are." (Read: The judges who overturned Ricci were not only wrong, they were limited by their experiences and empathy. And now we know "who they are" – bigots.
The Supreme Court nailed this one. I am pleased that the firefighters decided to pursue this one to prove that they weren't trying to be racist. They wanted the situation to be treated fairly. Judge Sotomayor is going to have a long Supreme Court career if she makes continued decisions like the one that cost these 20 firefighters potential promotions. New Haven, CT will have this decision staying with them for a few years.
She is part of an angry Obama's plan to "even the playing field". This group of bigots is truly amazing!
One problem with that statement. She sought to TILT the playing field because of what she believes are the "sins of the past". Just like the big "O", whose wife thinks the country has been "mean".
At the rate that BO is going to "even the playing field" he is showing how un-intelligent his choices have been. If he thinks that by nominating racist minorites evens anything out he has another coming. All he is doing is lowering the bar. The only creds anyone in the US will need is: 1. skin color 2. comes from bad home life or 3. comes from wrong side of the track.
Please say "Here" if you are surprised that her prejudiced decision was overturned.

Right on, man. She was legislating from the bench instead of upholding the LAW. She's a bad choice for judge, a very bad choice, because she doesn't do the job of applying the LAW.

I think sometimes the Supremes are on our side. This is one of these times. They were careful and didn't blame anyone. I guess we should be greatful when something is done right. I wonder if they are still looking at the things the lawyer turned in concerning BHO's citizenship. I heard Judge Ileto is going through the info and there is boxes of it. We will have to see if the Supremes do anything about it.
I'm a White Phila. Firefigther and I think its Great! The problem is we have a written test (Multiple Choice) that somehow the Club Valiants always seem to score high. Remember no one is suposed to know where the ??? come from! I took the test but didn't study much and still managed to be invited to the orals, which is the 2nd part of the test. The proctors for the oral are supposed to be Color Blind, but in recent tests their were more canidates of color that were promoted. I know I did a great job, because my scores were 9/8 and 9/9 and I didn't make the list. I went to review my test and found out I received a grade of 63 on my written. I told the person at the review how did I manage to get to the oral with a 63 and why did the city have me waste my time to study and take a day off for the oral? Her reply to me was, "I fell into the lower part of some BELL CURVE"! Turns out that my 63 was about 49 or 50. Thank you New Math!
Sotomayor is a racist and should be held accountable for her racist attitude!
The high court did the right thing…. As for Sotomayor the fact that she was overturned is one thing but it was what was overturned that is really disturbing. She issued a 134 word summary judgement in this case, the ONLY way that that is possible is if she had her mind made up before she even looked at the case. A judges' job is to intrepet the law not rule as they feel or believe. THIS WOMAN MUST BE KEPT OFF THE SUPREME COURT!!!!
I think the important part of all this is that the Court has ruled on reverse discrimmination….. Whites can't be discrimminated against just to give minorities a job anymore. I think that's BIG!!!
Agreed… she did not apply the LAW and that is the job of a judge, not to exercise "empathy" or legislate from the bench.
As for those who thought that the test was discriminatory by having a direct impact on members of one group, i agree. it whole heartedly seemed to discriminate against a group of people who did not prepare themselves for the test as must as the group who DID prepare themselves for the test. That's called …. a good test. I guess like the last time we saw this "test" thing raise it's head in our public schools, we will see our civil servants testing lower the bar to all time lows each year.

"she doesn't legislate from the bench" …. how can you say that? that's not even in question becaue SHE SAYS SHE LEGISLATES FROM THE BENCH!!!! You're right. Actually I had a discussion with some of my New York friends, who tend to be wiseguys and use that word with the "D" a lot when referring to certain individuals. We defined it as someone who is trying to look really together and thinks he is but really isn't. That's a D-bag, and Gibbs really qualifies under that definition. I don't think Hannity has ever been entertained this much by a total D-Bag. He's an overload of material for a guy like Hannity to take shots at.
Sotomayor is a racist that wants, as Obama does but never comes right out and says it explicitly, to actually make the playing field tilted to the people he thinks were slighted in the past. So two wrongs make a right? Get a life, Obama. A real, honest one. Don't just do your wife's bidding because she thinks the country was "mean".
Obama wants to spread the wealth around by taking from rich people that worked hard to get what they got. He was blatant about this and all of his programs are going to do that. He's figured out that you can get the backing of some huge corporate interests on green initiatives, get ACORN to rile up the many many low and no income people to vote democratic, and tax the living hell out of the moderately wealthy that really worked to earn what they have… most of which are republicans.
She is a RACIST along with the 4 that voted for the ruling…They are just too dumb to see it.
How did we get such idiotic people running our Nation? Where is common sense? Do they feel like reverse discrimination should be the payback for my ancestors transgressions? When is it going to die? How long do I have to pay for a moron with a sheet over his head?

my buddy, X-Marine, (white male 30's awesome shape): California burns yet he can not get a job with the FD.
my other buddy, X-Navy, (white male 30's awesome shape) lives in S. Florida, certified in everything, can't get a job. again, Florida burns every year but yet he has to go to Iraq to fight fires.

Not to pick nixs, but there is no such thing as an X Marine, once a Marine always a Marine, except for lee Harvey Oswald and John Murtha these are 2 X-Marines. I bet that if they were black, hispanic, gay or someother "minority" or special group, that couldn't pass the test they would be hired in a heartbeat. Face, it being vet, having served your country does not mean ditty to the state governments, they have taken the vet perference out of the hiring procedures here in KY. The worst part is that it is proven that Vets have better work performance, less absenteeism, and in general make better employees. But for some reason, state governments don't want these type of employees, Vets were go enough to go and defend our country and get killed or wounded, but they are not good enough to work for the state. Well, that's the New Improved America. By the way, I am "lucky" enough to have a job with the state, and only 1 of 2 vets in my division
They don't want us in the State Gov jobs because we are all nuts.

Vet preference is a label these days. It's a target on your back – and that is unfortunate. It's true, studies have shown vets to be reliable and diligent in their duties. Our Supreme Court has justly overturned Sotomayor's ruling about the correct advancement of personel to the leadership job! How could Sotomayer come to her conclusion in the first place. Most of the Firemen passed the testing for the advancement of jobs, but Sotomayer sided with the ones that gave the job to a minority, even though he failed the testing procedure! This is plain discrimination, and how could Sotomayer come to this conclusion?
Obama nominated her for the Supreme Court, even though most of her judgements have been overturned by the uppercourt. So how dose this make her any candidate for the highest court of the land?

It has been said that 60% of her former decisions, were ALSO overturned by higher courts.
Why would we 2w3ant a person that is WRONG 60% of the time, be among those that make the decision of when a Judge IS right or wrong?
Would not all that is sensible say that her decisions ON the Supreme Court, would ALSO be wrong 60% of the time?
Can we not find a Judge that is at LEAST as good as a kid tossing a coin?
I am happy to hear the decision is overturned. The racism against whites is very old. I am hopeful that this will be looked at r/t sotomayor's Supreme Court appointment. I don't expect anything to come of it though. It is ok to be anti-white. That is not considered racism and that is so wrong.
I feel that any decision that favors one race or group over another without intelligent reasoning is prejudiced. Therefore logically I must disagree with quota systems for races for promotions or anything. As soon as one bends the law for one group and gives them favortism, what they are really saying is that group is inferior. They are saying, well, we know your group is inferior, so let us bend the laws in your favor. Now to me, that is extremely racist. In my case, I have travelled at least 2 million air miles and have never seen a race or culture I feel is inferior to another. Sotomayor is the true racist here, both in what she says where she feels her race and gender is superior, and what she does in the courtroom. I also heard today that 6 out of 7 of her decisions have now been modified by an upper court. Isnt 1 out of 7 a failing grade in school?
I am certain that if the Supreme Court had more "wiser Latino women", they would have reached a different conclusion.

Justice prevailed today. Unfortunately justice will be blind sided by her confirmation, she's the poster child for race biased decisions.
..Gosh..that girl just can't catch a break….she's only been overturned 85.7% of her decisions at the SCOTUS…hmmmm, that makes her even less accurate than the weatherman. Oh well, at least she is a dedicated racist.

I can't believe they got it right . when a person study to get a head it shouldn't matter what color his skin is, if you score the highest you should get the promotion.

New Haven is a microcosm of what is going on all over the country. Too many politicians are afraid of the 'R' word. Just because someone calls you a racist doesn't make it so, period. To say that the exam was rigged or written to cater to a certain race of people, in this case whites and hispanics, is a weak, weak weak excuse for failure.
Sotamayor has been selected to legislate from the bench, no question.
Sotomayor apparently has never heard of the mantra that justice is supposed to be blind.
It's about time that those who strove and achieved got the justice they deserved.
Why do we think, as a society, that it is fair to promote someone based solely on a classification the fall into. These men work in an occupation that not only puts their lives in jeopardy, but those who work with them, and those who depend upon them to be qualified to do their job.
What disservice it is to promote someone who is poorly qualified to handle the job. All in the name of "fairness," we place them in danger for the sake of having the correct number of colors, sex, ….. That's liberal compassion for you! How do you explain to a family that their parent/spouse died because they were poorly qualified for their job, or working with someone who was, but was promoted to meet quotas. That is simply criminal!
In such a situation as this, there never should have been any question raised about whether or not these men deserved the promotions they tested for. When peoples lives depend upon the competence of those in charge, it's ridiculous to even consider the classifications that an individual falls into, and whether or not there would be a lawsuit. Would you choose to have surgery performed by a doctor who got his license for the very same reasons?

I have seen a lot of dancing from the left on how this won't have any effect on her hearings. They are concerned since this is a significant part of her public comment on the record. It's good the court did what it did because it pulled back on the overzealous application of title VII. Sotomayor is a product of Title VII and has discussed how it helped her into a school she thought she wasn't able to go to because of her SAT/ACT scores. Hmmn.
The idea that the city had placed so much concern without merit that they could be sued solely because no blacks made it is,to me, the most troubling part of this whole case. If you do an honest job and find results that are different than what you expected take the time to research the test and if you cannot identify a built in bias you go with those results. I can't see a court slamming the city for responsible behavior, this was not responsible behavior it was a knee jerk reaction. I think most people see it that way.
Justice Anthony Kennedy authored the opinion in favor of Frank Ricci and his fellow firefighters who sued the city of New Haven.
"The city's action in discarding the tests violated (federal law)," the Supreme Court majority wrote Monday, adding that the city's "race-based rejection of the test results" could not be justified.
The city argued its action was prompted by concern that disgruntled black firefighters would sue. But that reasoning didn't hold sway with the court's majority.
"Fear of litigation alone cannot justify the city's reliance of race to the detriment of individuals who passed the examinations and qualified for promotions," the court ruled.
This decision, like many of the close cases before the high court, divided along its familiar ideological lines. Kennedy was joined by the four conservatives on
Boopster, I agree the Supreme Court did the absolute right thing, but the vote was 5-4, not unanimous. She will still be confirmed.
I also agree that her empathy will likely always favor people of color. That is unfortunate, and this decision will probably not derail her confirmation.
Jerseygirl, hope you are wrong. : ) I plan to continue to fight onward and with any luck see her not confirmed. I have seen very little from other Judges she has served with or her clerks to endorse her as a person or Judge. Huge red flag imo.

I was extremely encouraged that the Supremes overturned Sotomayors decision in this case. Now we may have a chance to defeat her appointment for a lifelong position!

Empathy is a very dangerous anchor from which to render a judicial decision. It is possible to opine (of course from a very sick perspective) that it was because of empathy for european non-Jews that the holocast was set in motion.
Both Obama and Sotomayor are of the same mind: tilt the playing field for a while in favor of minorities against white people. Make allowances for the past. Issue a national apology for slavery over from over 150 years ago and back. Treat illegals like citizens and applaud them for standing up for their "rights". On another note…. I really must applaud those firefighters. They lived up to their profession and fought quite a fight. Good for them!!!!

Sotomayor is a disgusting racist. Listening to her talk so proudly about how she became a judge at the expense of better qualified people who were white makes my stomach turn. Supposedly racism is a terrible thing, but if you are racist against whites, you are truly noble. I wish I could live to see a time when all of these white people who are attacking and selling out their own race for political power get what they deserve.

Hey Richard. I've mentioned this before in a reply to someone else. I am a former Marine and I applied with the Census Bureau in my area a few months ago because I wanted to participate in the Census to watch for B.S. When I applied, it was in a group setting and the recruiter right away asked if there were veterans in the room. I raised my hand and she told the rest of the group that I would receive priority. At the time, I thought it was strange but I know the way the government operates. I did receive a decent offer for a part time position but I couldn't make the hours work with my full time job schedule. The key thing is, this all happened before Obama shifted the Census to another agency. Anyway, for what it is worth…. Take care, friend.
He was out of Camp Lejuenne(sp). Its sad that it is that way, but the Dems/Lib have hated the military since the 60's and will continue to undermine them as much as possible. It is a sad truth, but till people change, its something we have to learn to live with.
