    When Obama's choice for a Supreme Court Justice is approved, I'd be willing to bet that the 2nd Amendment will be challenged again. I've been a law abiding citizen all of my life, but if they ever come for our guns, that is the day I will become an OUTLAW by the government's standards and a RESISTANT PATRIOT by the Constitution's standards!

    This was the reason I voted for McCain…. just so we could maintain some control of the Supreme Court nominations. I must say I was surprised when Souter announced he was stepping down. I thought Ginsberg would drop first. I recently heard that the Supreme Court is Obama's forte and the main thing he is interested in. Isn't that just dandy news! I'm trying to imagine what the road is going to look like that he will be taking us down. Scary thoughts!

Abortion will be the first question on the test, miss it and get the rest right will disqualify the person!! Your "War Games" analogy is dead on!!! I just hope that we can return some resemblance of America after the 2010 election, or after he has left office. It will literally take an "Act of Congress" to undo a lot of the damage. If he is in eight years (God forbid) there might be irreparable damage??

    Our founders wanted the law to be the basis of our courts decisions, and the Constitution. Not based on emotions and what the court thinks should be the right decision based on there own opinion, Or from other countries laws, or international laws like the UN!!

    When the candidate of choice is made, I strongly encourage you to not only research that candidate but the other choices as well. Because if the initial candidate is a bad choice, I suspect the follow up candidate will be even worse and I suspect he'll trot out someone that gets a lot of attention and controversy but ultimately fails. They know this and will pick a candidate that they know will fail so that the one they really want, the one we should really be worried about will be chosen.

    I find myself watching the opposite hand that DC asks me to watch.

    We the people need to file treason charges against each & every person in DC who swore an oath to protect the constitution and have not protected it. If you do not protect the constitution & you are an elected official you should be removed from office immediately & charged with treason.     I am a little worried about the highest court but that is not my greatest worry. Decisions do not reach the high court with out going threw the lower courts. Obama will replace at the very most 5 Supreme Court justices but with out a doubt will replace dozens and maybe hundreds of other federal judges. If he picks a less liberal than expected justice for the highest court please watch the other hand.

      He will never pick a true conservative and there will be a religious test about belief in abortion. He has also clearly said that he wants a judge with "empathy" so original intent judges are out. I expect he will pick some one as far left as he can get away with, but for the reasons Cliff said we are in deeper trouble if he picks someone less liberal than we expect.

    • The job of the high court is to uphold or overturn the lower courts. It is a difficult task to overturn, but they can uphold a decision by just not hearing it. We the conservatives need to not get caught up in the high court diversion, so we can raise a stink over every liberal in entry level jobs on the federal bench.

    I sure hope this nominee doesn't get Borked LOL. The Democrats are the most uncivil when it comes to Judicial nominees that follow the constitution rather than reinterpreting it, so Gibbs is telling the truth. Why would they trash one of their own? No way Obama is not going to nominate a constitutional Judge. After all the republicans helped nominate Ruth Vader Ginsberg I mean Bader by a vote of 96 to 3 in the senate. The Judiciary Committee voted unanimously in favor of her confirmation. Thank you Arlen Specter, Orin Hatch and the rest!

    • White Rose – unfortunately it doesn't matter what the minority party in the Senate thinks as it doesn't have the votes to block or filibuster this.

      I well remember then candidate Obama proclaim that the founding fathers got it wrong in the Constitution. I know that he will get 1, possibly 2 into this court. For a man that is supposed to be a constitutional scholar, it's remarkable how revisionist he is when it comes to what the Constitution says, how it is to be used. Stand by for judicial activism – we might as well toss out our 3 branches of government as two bodies will be competing for who makes law.

      I'm seriously angry with many of the voters of the country who allowed this incredible imbalance of power happen. To grant one party sole control is putting the fox in the henhouse – and there is going to hell to pay for a very long time because of so many ignorant voters.

      Obama will most likely nominate a far leftist woman and the Repubs will do as they did with Ginsburg. There will be a few good questions, but, in the end, most will vote to confirm. Stating that thier role is to 'advise and consent' like they tried to get the Dems to do for Bush nominations. They will take the 'high' ground, which apperently is on the Left!

    I just saw where the AP reported Napolitano is on a short list for BO's Supreme Court nomination. Could this just be a tactic to scare everyone so that when he does appoint someone, the public is just like, "Whew! Glad it wasn't that Napolitano woman who can't/won't even secure our borders!" Just ANOTHER distraction technique we don't pay much attention to what the other hand is up to.

    Besides, in order to have all the empathy that Obama has said is important (never mind a working knowledge and respect for the Constitution–the supreme law of our land!) this appointee will have to be not only female, but also an unwed, poor, homosexual, disabled, teenage mother.

    Justice is to be BLIND–not a sympathetic ear and soft heart–but a follower of the laws which are already laid out.

    The sad, sad consequence of Supreme court nominees being inducted for life, is that sometimes generations of Americans are impacted by their decisions. If Obama's choices for cabinet members are any indication of what to expect in a nominee, we will see the constitution re-written again. When the Supreme court can even consider overturning the will of the elect, we are in trouble legislatively, financially, and morally. Read up on the first Supreme Court sessions…they were never intended to have their tentacles into every facet of society as they do today. In fact, at the time the judges only served part time…a time when WE THE PEOPLE meant something.

    He has made his position clear in various public interviews over the last decade. BH0 sees our Constitution and Bill of Rights as negative. He believes in social justice, that the wealth held by the few was accumulated by trampling on others, and those others are the rightful owners of that wealth.       Number 1 it will most likely be a woman–and that Sotomayor woman kills two birds with one stone. She's Hispanic and a woman. Even if the choice is a liberal, I really believe that a Supreme Court justice should have extensive judicial experience—having served at the federal District Court level at least—preferably at Circuit Court level. I would wish that the Senate would limit themselves to a person's character rather than their views when vetting. But then one has to worry about false accusatiuons. We saw what Bork when through as did Alito and Roberts to bring it more up to date. Luckily with Thomas, the accusations didn't stick, but I am sure that man went through immense pain at his reputation being trampled on.

I choose an ummm…foreign born, black, man hating, baby killing lesbian that is a single mother with a recently printed marriage certificate that has parents living in the US illegally and preferably way behind on taxes, just to keep with the status quo. Add to it or amend it (with good argument) and see what we end up with!

    Congress and we the people are supposed to make the law, but Obama and many others are worried they won't get the votes they want for change, and want the Supreme Court, 9 people not even elected, to make the laws they want. it has never worked well for either the constitution or human rights. In 1857 the Supreme Court decided that all men are created equal must mean Black people aint got no rights (Dred Scott Decision), and continued slavery, overturning the Missouri compromise where the more intelligent states started to outlaw slavery. Then Roe vs Wade based on two lies – rape and desired abortion – was used to make a new law that people could kill babies whenever they wish. What about babies rights? Anyway, McCorvey (Ms. Roe) later went pro life and asked the Supreme Court to overturn their decision and they just seemed to laugh. This group, called the Supreme Court, worries me even BEFORE Obama wants it to ignore the constitution and human rights even more.

    If Obama believed in our Constitution, he would look for a Judge that would make decisions by the actual meaning of the Constitution instead of one that searches all over the world to find laws that were never made by the American Legislature, that support his so called Empathy. I think any Judgment not made by a clear reference to our U.S. Constitution, should not have any relevance. Supreme Court Judges should only be able to strike a law down, not make law from the bench. If found unconstitutional the law should be thrown out completely or Congress should be allowed time to look at whether they can make acceptable changes that will pass the Constitutional test.

        The Supreme Court isn't supposed to make law, they are supposed to decide on the constitutionality of a law.The legislature is the only branch given the authority of making Law, not an Empathetic Judge! I guess the true intent of our Constitution doesn't match your distorted view of how things are supposed to be.

    • I think what's going on right now, as I see it, the far left still sees America as the 1960's and 70's etc. Think about it. A few decades ago, people were fighting for black rights, women's rights, etc. They had to change up things in society. Today, they want to do the same things. They think that certain people have certain rights, and they believe that the whole of America needs to continue changing.

      There was an add to the constitution for women's rights and African American rights, for example (I know it happened before the age of Aquarius). Far left people believe they themselves are doing justice in further input (to name a few examples: homosexual "marriage," abortion rights, illegal alien rights, terrorist rights). That people are opposing, is no different to them than if people opposed women's rights or African American rights. So, it makes sense that the further right agenda does not matter a lick to them. They truly believe that our ways are stubborn and just simply immoral.

    In Nov 07 Aus elected a new ultra left Labor party. the new PM has a nick name of Kevin 747 because he spends so much time abroad, his cabinet is made up of trade union members, and 2 things that will make you tear your hair out;
    1. Aus with a population of 20million, handed that new government a budget surplus of 22 Billion$, now 18 months later the deficit is $60 Billion, and yesterday they released a new buget with a 13.8 percent of GDP deficit of 100 B.
    2. Recently the defense minister(equiv. of secretary of defense) was caught having had 7 first class trips to China paid by a chinese "business woman" he then lied about it on TV, she had also paid for his campaign, and he had forgotten that he actually lives in her house, and a few days ago it was revealed that she has ties to chinese military intelligence.So was he fired, or tried for treason? No the left is never held accountable.
